Troopers arrest man on second DUI charge after .240 breath test

A man was arrested Friday in Fairbanks on a DUI charge after a breath test showed three times the legal limit, Alaska State Troopers said.

Troopers stopped him September 18 after his vehicle failed to maintain its lane, per trooper dispatch AK26093020. He showed signs of impairment and numerous indicators during field sobriety tests. After his arrest he gave a.240 sample on a DataMaster breath test instrument.

A records check found it was his second DUI offense, and he was jailed at Fairbanks Correctional Center. Alaska law presumes impairment at 0.08 grams or more per 210 liters of breath.

A second DUI conviction carries minimums of 20 days in jail, a $3,000 fine, 12 months of ignition interlock, one-year license revocation and $1,467 in imprisonment costs, the Alaska Court System says. The charge is an accusation; he is presumed innocent unless and until proven guilty.
