Alaska Supreme Court declines emergency bid to open Fairbanks charter school

The Fairbanks school board voted unanimously not to allow a charter school. The state approved it anyway. When the district sued, the Alaska Supreme Court declined to step in, leaving 352 enrolled students waiting on the outcome.

The board denied the Pearl Creek STEAM application on Nov. 4, 2025, saying the planning was inadequate and that the school could not afford the programming it proposed. The education commissioner's designee approved it on appeal in January, and the state board granted it a five-year term running through June 2031. The district appealed that approval to Fairbanks Superior Court in May.

With hiring deadlines closing in, the state board and the school's academic policy committee went to the Supreme Court on June 18, asking it to reverse the superior court. They argued the state board's approval was final agency action binding on the district, and that "352 students stand ready to attend." They needed an answer within days: positions had to be posted immediately, teachers hired by the end of June, and a principal brought on first to help hire them.

The district's response was procedural. It argued the petitioners had shown no compelling reason to skip ordinary appellate process, that forcing the school open would disrupt the district, and that its own appeal should finish in superior court before anyone ordered anything.

The court denied the petition, leaving the superior court's order in place days before the hiring deadline.

Separately, the borough has proposed spending $268,000 on maintenance at the closed Pearl Creek Elementary School and leasing it to the charter school, contingent on a final approved contract. The fiscal note says the charter would reimburse the borough in full, so the arrangement would not require an annual subsidy.
