USDA local-food rule for Alaska school and summer meals takes effect Nov. 9 unless comments stop it

A USDA direct final rule, Simplified Geographic Preference Procurement in Child Nutrition Programs, takes effect Nov. 9 unless the agency receives written adverse comments by Oct. 9, giving Alaska school districts, child care providers and summer meal sponsors clearer rules for favoring local fish, produce and meat in food bids. Adverse comments would force a withdrawal. Comment at regulations.gov, docket FNS-2025-0013.

Published Sept. 9, the rule covers programs including the National School Lunch Program and the Summer Food Service Program. Sponsors may write a local product specification into a solicitation, give bids a scoring advantage, or both, using terms such as "local," "locally raised" and "locally caught."

The option itself is not new: USDA's 2024 rule first allowed both strategies and left operators to define "local." USDA calls it a clarification. It remains optional. The National Sustainable Agriculture Coalition says clearer mechanisms benefit local producers but could disadvantage vendors outside a sponsor's defined area.
