Kodiak Borough: Planning and Zoning Work Session of June 10, 2026

Have it written in the designation. One of the things that we wanted to have— again, it's a policy guide, so we can't— it could be overruled by the Assembly and certainly as a legislative action. But one of the things we wanted to do in the future land use map to have the hazard overlay is to put that over there. And if someone were to come in for rezoning and they're in the hazard overlay for a higher density residential, staff's concern was putting more higher density residential in the inundation zone or in a zone that's prone to flooding or one that's prone to landslides or whatever the hazard may be is to make sure that, you know, those are scrutinized much more closely than the normal rezone just because of their situation.
I think that's wise.

Okay. Let's head to packet review.
All right. So we're going to talk about Case 2619, which is a request for a conditional use permit in the City of Carlock to— or excuse me, in the Carlock Village to— I get the city confused because it's on property in trust to the state for in the future if Carlock was to ever become a city, then that property would revert. To the new City of Karluk. So the property that we're talking about here is in trust to the State of Alaska for Karluk if it's ever incorporated as a city. But we're talking about right now the Village of Karluk.
And this current zoning for this piece of property is in the C Conservation Zone. The proposed project includes replacing an existing water tank, extending new water mains and service lines to be to provide year-round source of potable water. Those lines would go to the current property that has the water treatment plant, but that water treatment plant is part of this project. All the equipment with inside that building, everything is being replaced and improved. Conditional Use Permit is required in the C Conservation Zone for a utility facility, and so similar to what we did, if you remember, when we had the— in Old Harbor where we had the hydroelectric plant, similar situation being zoned Conservation.
I will say this, there's a part of this property— this is a split zone property, so part of this property is actually in the Watershed Zone, which this use would be a permitted use. However, it looks like maybe a portion of the— of this water tank site might be in there, but certainly not all of it. And so for us to be —on the conservative side, we're having the conditional use permit come through for this project. But for the zoning compliance permit, we're going to look at it as partially in a C zone with a CUP and then the other part of it being in the watershed zone, which typically would allow the use. Staff has reviewed this against the requirements of the conditional use permit.
Staff finds this use in compliance with the conditional use permit. You have your staff analysis on page 3 of 6 of the staff report. You have staff recommended findings starting on page 5 of 6. You have 2 recommended conditions of approval for the CUP and then you have the attached resolution proposed FY 2026-22 which recommends that the Commission approve the CUP. CUP.
If you have any questions, I will be happy to answer those. I would also like to add that I passed out a paper that was received after the agenda was posted, but this is a public comment from one of the property owners adjacent to the plant.
Thank you, Hayley. And that comment is in support of the conditional use permit. Okay. I have no questions, but I'm happy to see that this is going through. I know that it's sometimes a struggle to get good water in the villages, so I'm excited to be helping them to fix theirs.
Yeah, and we're happy that we did get a comment in support that did a very good job of expressing the need for the improvements for the water treatment plant as well as to water for the community. Yeah, I'm definitely comfortable with this one. I mean, you guys have conditions that they already know that they have to follow DEC's recommendations, right? But I don't have any concerns that that's going to be an issue. Seems like a lot of work was done looking through all this.
And the reason we have that condition in there is because, you know, there's a preliminary approval from them, but they will need to to get their further approvals for the final inspections and everything once everything is constructed.

Looks like that was our only public hearing item. No old business, no new business. Just gets us to reports. So our meeting schedule here, we have our Regular meeting next Wednesday the 17th at 6:30 PM here in Assembly Chambers, and our next work session scheduled for Wednesday, July 8th at 6:30 PM, also here in Assembly Chambers. Um, no abbreviated and final plat approvals, um, and then two approval letters under communications.
So those are in your packet for anybody, uh, who wishes to look at them. Staff comments. Yeah, the only thing that I have is I wanted to let the Commission know about the Uzinkis' tsunami shelter that went through for the rezoning review, also the subdivision. But the rezoning is going to be going to the Assembly for the June 25th work session and then for introduction at the July 2nd regular Assembly meeting. Just want to keep you up to date on that.
And staff is continuing to work on Plan 2045. And we do plan to have— hopefully, we will start having drafts of chapters to you starting with the July meeting and have a little better idea for you in terms of how we are going to get public comment. But first, we are looking to get some Commission comments, also agency comments as well. Before we kind of put it out for the public. But the idea there, again, I think I mentioned this before at previous meetings, is that we will have public meetings and we will have ability for people to comment on the document online as well.
