My concern is not with the bill's objective, it is with how it would be implemented. As drafted, the legislation could require many dairy products, including milk, cheese, and yogurt to carry an FDA warning label unless the FDA chooses to exempt them through its regulatory authority. This places tremendous weight on agency discretion rather than providing a clear direction in statute. Unfortunately, FDA leadership under Republican and Democratic administrations have long refused to enforce proper nutritional labeling standards that already exist for dairy products. I oppose this bill today because I think we have more work to do to get this right.
