At 1:55:40 of the meeting, the statements— the attorney's memorandum said that Scott informing Eric that a permit is needed and that his culvert does not conform to Whittier specification standards. It stated that Scott told Eric that his culvert has design flaws for potential freezing, creating blockages and potential flooding. It then went on to mention that Scott informed Eric of where he could obtain a permit application and where he could purchase approved culverts for Whittier projects. It then concluded the phone conversation stating that Scott had said, "You shall not install or perform any work within the drainage ditch without a signed permit," and that Eric responded he intended to install the culvert and continue with the work anyway, and that Scott finished the conversation stating proceeding with the work without a permit could result in legal consequences. At 2:0018 of the meeting, the attorney's memorandum made statements that the director of public works had observed the work done in August 2024.
